Terms of Service

By downloading, installing, or using the TextJam mobile application ("App") or any related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

We reserve the right to modify these Terms at any time. Your continued use of the Service after any changes constitutes acceptance of the new Terms.

TextJam is a mobile application that allows users to create original music videos from text conversations. Users can upload screenshots of conversations or manually input text, select a musical style ("vibe"), and our AI generates an original song and video based on the content.

To use certain features of the Service, you may need to create an account. You agree to:

• Provide accurate and complete information when creating your account
• Maintain the security of your account credentials
• Promptly update your account information if it changes
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

TextJam operates on a credit-based system:

Free Tier

• New users receive one free video credit upon registration
• No credit card required for the free video

Credit Packages

• Credits can be purchased through in-app purchases
• Each video creation uses one credit
• Purchased credits do not expire
• Credits are non-refundable except as required by law

Subscriptions

• Subscription plans provide a monthly allocation of credits
• Unused credits do not roll over to the next billing period
• Subscriptions auto-renew unless cancelled before the renewal date
• You can cancel your subscription at any time through your app store account settings

"User Content" refers to any text, images, screenshots, or other content you upload or input into the Service. By submitting User Content, you:

• Retain ownership of your User Content
• Grant us a license to use, process, and store your User Content to provide the Service
• Represent that you have the right to submit the User Content and grant us this license
• Understand that User Content may be processed by AI systems to generate music and videos

Videos and songs created by the Service ("Generated Content") are subject to the following terms:

• You own the Generated Content created from your User Content
• You may use, share, and distribute your Generated Content for personal and commercial purposes
• Generated Content is provided without watermarks for paying users
• We reserve the right to use anonymized Generated Content to improve our AI systems

You agree not to use the Service to:

• Create content that infringes on intellectual property rights of others
• Generate content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
• Upload content containing personal information of others without their consent
• Attempt to reverse engineer, decompile, or extract source code from the App
• Use automated systems or bots to access or use the Service
• Circumvent any technical measures we use to provide the Service
• Use the Service for any illegal purpose or in violation of any laws
• Create content that promotes hate, violence, or discrimination

The Service, including its original content, features, and functionality, is owned by TextJam and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

The TextJam name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of TextJam. You may not use such marks without our prior written permission.

The Service may contain links to or integrate with third-party services (e.g., social media platforms for sharing). We are not responsible for the content, privacy policies, or practices of any third-party services.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, secure, or error-free, or that any defects will be corrected. AI-generated content may not always be accurate or appropriate.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TEXTJAM SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

• Your use or inability to use the Service
• Any unauthorized access to or use of our servers and/or any personal information stored therein
• Any bugs, viruses, or other harmful code that may be transmitted through the Service
• Any content obtained from the Service
• Any errors or omissions in any content

You agree to indemnify, defend, and hold harmless TextJam and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with your access to or use of the Service or your violation of these Terms.

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will cease immediately.

You may delete your account at any time through the app settings. Upon account deletion, your User Content and Generated Content will be permanently removed from our systems.

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved in the courts located in San Francisco County, California.

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
